DATA PROTECTION
In compliance with Spanish Organic Law 15/1999 on Personal Data Protection, Keratoconus Solutions S.A. informs the users of our websites that any personal data obtained by the company through filling in any of our forms, will be owned and controlled by Keratoconus Solutions S.A. in order to facilitate, expedite and fulfil the commitments established between the two parties.
If you do not inform us of the contrary, we will assume that your data has not been modified and that we have the consent to use it for as long as we deem appropriate.

PRIVACY POLICY
This privacy policy has been prepared by KERATOCONUS SOLUTIONS S.A. in accordance with the provisions of Organic Law 15/1999, of 13 December, on Personal Data Protection (henceforth OLDP), Royal Decree 1720/2007 which approves the Regulation of Development of the OLDP, directive 2002/58/CE of the European Parliament and of the Council of 12 July 2002, concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications) and directive 2009/136/CE, of the European Parliament and of the Council, of 25 November 2009 (known as “cookies directive”).

IDENTITY AND ADDRESS OF THE PERSON RESPONSBIBLE FOR THE FILE
By virtue of the applicable legislation regarding data protection, KERATOCONUS SOLUTIONS S.A. with registered office in C/Charles Robert Darwin 22, Parque Tecnológico 46980 Paterna Valencia – T.+36 961 122 153 F.+34 963 891 886. Mercantile Registry of Valencia, volume 9422, book 6704, sheet 220, Page V-146916, first inscription 24-1-12 VAT A98407463 (hereinafter KC) informs that all data submitted through our electronic forms will provide us with personal data which will be automatically processed and incorporated into an automated file named “Gestión-Fiscal”, previously notified to the Spanish Data Protection Agency a, and incorporated into a file called “Pacientes”, of which KC is the owner.

DATA TREATMENT PURPOSES
The collection and automated handling of your Personal Data has the following purposes:
Enabling user registration and user access to the platform, to access certain contents about services we offer. In order to access and have a user account you will need a login.
Moreover, you hereby consent that your data can be processed for advertising or marketing research purposes, including its use for electronic commercial communications purposes to promote our products or services, as well as similar endeavours.
You agree that your data will be used in this way and that it shall not be used for other purposes. Likewise, we inform you that through our Social Networks (Facebook, etc…) and by becoming our fun, you can provide certain personal data which will be automatically treated and which will become of KC´s liability. The collection and automated handling of your Personal Data has the purpose of enabling the communication in our Social Network, in a way that as a result of the platforms or social network setup, you give your consent for your data to be treated for advertising purposes and of commercial research, including the sending of electronic communications.

ARCO RIGHTS (access, rectification, cancellation and objection)
Please be informed that as owner of this data, you will always have the right to access, rectify or cancel the information or object according to the terms stated in the data protection legislation. To that end, simply send a signed written request to KC, with registered office in C/Charles Robert Darwin 22, Parque Tecnológico 46980 Paterna Valencia – T.+36 961 122 153 F.+34 963 891 886 or send an e-mail to the following email address info@kcsolutions.com, with the following contents:

If the request is made by the person concerned:

  • Identity of applicant: Name of the applicant and a photocopy of ID. The photocopy of ID may be replaced provided that proves the identity of any other valid means.
  • Address for correspondence, date and signature.
  • Petition in which specific application (access, rectification, cancellation and opposition). If exercising the rights of correction or cancellation must indicate which data is concerned and the correction to be performed, if necessary.
  • Provide evidence in support of the request being made.

If the application is exercised through voluntary representative / legal:

  • Identity-represented: a report of a copy of ID card or equivalent document
  • Representation afforded by the holder of personal data.
  • Address for correspondence, date and signature.
  • Petition in which specific applications (access, rectification, cancellation and opposition). If exercising the rights of correction or cancellation must indicate which data is concerned and the correction to be performed, if necessary.
  • Provide evidence in support of the request being made.

INTERNATIONAL TRANSFER OF DATA
Please note that in order to provide efficiently its services and assure its objectives, KC needs to provide third parties personal data, including international transfers to our provider in Germany, located in KARLSRUHE which is part of state: BADEN-WURTTEMBERG. The exact address is: Ernst-Frey-Str. 10City: Karlsruhe Postal Code: 76135. You hereby consent this international transfer of data.

ACCESS TO PERSONAL DATA
In accordance with the provisions of article 12 of the OLDP, with respect to customer data hosted in websites to which we have access as a result of managing customer’s registration, we will act on the basis of the mandate they have given us.
Nevertheless, KC will conduct its work in accordance with the customer’s instructions, who will be responsible for the treatment of the data that they may carry out themselves, thus exonerating KC from responsibility for infringements that the customer may carry out in questions of OLDP, using the data exclusively to carry out the services provided and not revealing it to third parties.
KC will establish for such service or access, the safety measures to be adopted depending on the ones owned by the customer, legally required, of a technical and organisational nature to ensure the security of data and avoid their alteration, loss, unauthorised mishandling or unauthorized access or treatment, given the state of technology, the nature of the data stored and the risks they are exposed to. KC will provide basic safety measures, except otherwise indicated by the customer, in which case it will be the customer´s responsibility to inform whether they need medium or high safety measures in place. In the event of implementing safety measures in accordance with Royal Decree 1720/2007, the implementation costs will be charged to the customer.

SAFETY MEASURES
Please be informed that we store the information you provide in a secure database with standard security measures such as the ones available through “Secure Sockets Layer” (“SSL”), firewall, etc. Furthermore, KC has adopted the legally required safety measures in its facilities, computer systems and files in accordance with the provisions of DR. 1720/2007 of 21 December, which approves the Regulation implementing Law 15/1999, depending on the sensitivity of the data it provides. Furthermore, the data controller ensures the confidentiality of personal data, but will reveal personal data or any other information in its possession or accessible through its systems to public authorities, if required under the laws and regulations.

USE OF COOKIES
We also inform you that when you connect to our Web page, our server automatically recognizes the IP address of your computer, the date and time you entered, and when you abandoned us, and which parts of our website you visited. This is necessary so that our computer is aware of this information from your computer and in this way we can get in contact with your computer to send what you ask through your browser and ensure you can view it on your screen. Moreover, we will run statistics on the site traffic. By accessing and registering, you hereby allow the use of “cookies” to improve the service we provide. You may have the option of disabling cookies via your browser preferences, although doing so may prohibit you from accessing certain parts of this website.

TOP QUALITY, LOWER AND REVOCATION
The data controller ensures to maintain the quality of the data you provide, ensuring that it is adequate, relevant and not excessive for the legitimate purpose of treatment. Users guarantee and respond, in any case, of the truthfulness, accuracy, validity and authenticity of the personal data provided, and undertake to keep it updated.
KC services are not destined for minors and KC does not request nor does it collect information relating to minors.
In accordance with the provisions of Article 17 of the Regulation implementing the Data Protection Act you may revoke consent at any time. If you provided personal information through any means with respect to services offered by the website and want to revoke your consent given, direct us an email to the following email address info@kcsolutions.com.
In the event that the data protection policy had to change as a result of legislative changes or criteria derived from the Data Protection Agency you would be adequately informed about any changes that may be necessary to introduce to comply with the law.
